!These Terms and Conditions ("Terms and Conditions") are entered between you ("User" or "You") and the operator of this website (the "Website"), Kenes International Organizers of Conventions Ltd., and any of its affiliates and/or parent companies (the "Operator", "We") and will govern your use of this website and any of the services and/or products offered and/or provided to you hereunder and/or in connection thereby by the Operator and any on its behalf (the "Services") . Please read these Terms and Conditions carefully before using or accessing this Website and/or the Services and making any booking. Your use of this Website and/or the Services constitutes your agreement to all such terms, conditions, and notices, as stipulated below and updated by us from time to time. If you do not agree with the Terms and Conditions then you are not authorized to, and must not use this Website and/or the Services.

Registration; User Account

Users must register to our Website and open an account (the “Account”). In order to complete the registration process Users shall provide us with certain information as specified in our Privacy Policy. You will also be asked to choose a password, which you agree to keep in strict confidence at all times. You are solely and fully responsible for maintaining the confidentiality of the password and Account and for all activities that occur under your password or Account. You may not assign or transfer your rights or delegate your duties under the Account without our prior written consent. You must notify us immediately of any unauthorized use of your password or Account or any other breach of security. We cannot and will not be liable for any loss or damage arising from any failure of yours to comply with these terms or from any unauthorized use of your password or Account or any other breach of security. In the event of the aforementioned, you may be liable for the losses of the Operator or others due to any such use.

Rates Rates displayed on our Website might be for the total duration of the whole stay/service and for the total request, and/or per each day of stay, as per the search criteria input provided by you. Prices might or might not include service charges and/or local taxes. Breakfast and/or other meals are not included unless otherwise stated. Some hotels/travel suppliers/authorities may charge additional local taxes, which are payable on the spot.

Vouchers

Vouchers you receive from Us will entitle you to use the pre-paid services, strictly as specified in the voucher in terms of particular hotel/service, period of services and type of services. All and any extras/alterations to the above are at your sole discretion, those as well as additional personal charges, such as but not limited to, phone bills, laundry, room service, insurance and/or upgrades etc. will be settled by you directly with hotel/service provider on the spot.

Hotel accommodation

Hotel information appearing on our pages is strictly as provided by the hotels themselves, and/or the travel suppliers and we disclaim any representations and warranties in respect thereof, and are not liable for any omissions, errors, lack of or incorrectness of any part thereto. Hotel ratings, hotel information, maps and images displayed on this website are intended as a guideline only and are not binding upon us in any manner. "Run of house" - guest rooms are allocated by hotels upon check-in at hotels' sole discretion. Special requests such as non-smoking rooms, adjoining or interconnecting rooms, high or low floors etc, will be forwarded by us to the hotel/travel supplier but cannot be guaranteed. In most hotels normal check-in time is 15:00 hours and check-out time is until 11:00 a.m. Late arrival – most hotels keep the rooms booked for you until 6:00 p.m. local time on the day of arrival. If you are arriving to the hotel after this hour, you must advise us at the time of booking by providing your estimated arrival time. Should you fail to do so hotels will have the right to resell the room, and might not be able to accommodate you when you arrive. Please note that additional/cancelation charges may apply in these events. Providing us with the “late arrival” information is your responsibility, and we will not be held liable for any problems arising out of your failure to do so, and/or with respect to any hotel policy with respect to "late arrivals". We urge you to carefully review the relevant hotel and/or services providers' policies with respect thereto. Please be aware that hotels are under renovation from time to time. Hotels take all possible steps to limit disruption to their guests. We will not accept complaints, or requests for refunds, if a hotel is carrying out renovations whilst a guest is resident. Room types - SGL (rooms with one single bed); TWIN/DOUBLE (rooms with one double or two separate single beds); TRIPLE /accommodating 3/ & QUAD /accommodating 4/ - may consist of twin or double bed/s/ plus extra bed or two double beds. Extra beds are usually rollaway and not full size. In most hotels NO additional bedding is provided for a child where the child is free or at a reduced price, sharing twin/dbl room with adults and breakfast may be charged for child on departure. In the majority of non-European hotels, rates for triple and quad rooms apply to one room with two double beds. If an extra bed is required then an additional charge may be applied which should be paid directly to the hotel as it may not be possible to reserve prior to check in. In many hotels no additional bedding is provided for a child where the child is either free or at a reduced price and breakfast may be charged for the child on departure. If a child requires a bed of their own you must request a triple and no child discounts will apply. In increasing number of hotels worldwide, and particularly in the USA/Canada, you may be charged direct at rack rate, or accommodation may be refused, if you fail to present a valid voucher for all guests arriving. Therefore you must make sure that, if the reservation is for more than one room, all travelers' first and family names are provided by yourselves at the time of booking, and printed on the voucher. Please note that contracts with hotels could be based on our travel suppliers selling to the leisure market. In these cases, we cannot accept any responsibility if the client has a corporate rate agreement with the particular hotel/chain, and the hotel/service provider refuses to honor our booking, and/or elects to charge the full corporate rate of such client. Complaints must be reported to the hotel/service provider on the spot. We will not be liable for any compensation for any such problem, and strictly disclaim any liability with respect thereto. Dynamic rates and inventory - as we distribute also dynamic inventory (connected directly to the hoteliers CRSs where they perform current revenue management) for agencies/clients who have opted to stop their bookings upon or past cancellation deadlines, rates might be increased, and rooms might no longer be available on tour operator discount level, in the period between booking is made on our system and your reconfirmation to us to release the booking to supplier. Fairs and Special Events Special periods such as international and local exhibitions, trade fairs, congresses, conventions, holidays, sporting events etc. tend to attract high occupancy and rates for hotels and services. These periods are accompanied by special terms and conditions imposed by hotels/travel suppliers, generally there might be requirements for minimum stay, high rates (usually exceeding normal rack rates), longer cancellation and prepayment terms etc. Hotels restrict their special offers to apply as 1 x per stay of same clients - we cannot accept multiple bookings for the same property and the same passengers, made for the purpose of circumventing restrictions on free nights, special offers and minimum/maximum night stays (e.g. splitting of a 9 night booking into 2 separate bookings for the purpose of using 2 x 4=3 nights offer, at the same hotel). We will not be held liable for any problems arising out of such bookings made by User.

Group Reservations

Group bookings are subject to longer cancellation terms and early prepayment. You will be advised of the particular terms for each group booking upon confirmation from suppliers. Should you fail to comply with payment deadlines booking will be automatically cancelled and we will not accept any subsequent claims and/or complaints from you. Hotels usually regard party of 5 rooms and over as a group. If you book online on our system more than 6 rooms as separate reservations, the hotel might, upon discovering party arrive and stay together refuse to honor these reservations at our rates per individual and/or cancelation terms, and either cancel the rooms or impose higher rates/ aggravated terms, at their sole discretion. You should therefore not make group bookings by splitting them into individual reservations. Whenever such cases are discovered, we will be obliged to follow the hotels’ decisions and instructions, which might among other consequences, incur such rooms being cancelled, or rebooked at higher rates and longer cancelation terms. In such cases we will bear no liability whatsoever towards yourselves and/or co-travelling clients.

Cancellations, amendments, claims, service provision limitations

Cancellation and amendments deadlines are calculated in line with CET (Central European Time). Deadlines apply for each particular booking request and depend, among other factors, on the service type, the travel supplier, dates of travel etc. The cancellation deadline will be provided together with your booking confirmation, except as detailed in special cancellation alterations below, where it will be provided by us after receiving notice thereof from the hotel/travel supplier. If you cancel past the current deadline, you will be charged a minimum of 1 night/day/unit cost of each service, and up to 100% of the total amount booked, depending on the hoteliers/travel suppliers’ polices. Cancellation charges apply for cancellation requests made before the day of arrival. Any cancellation made on the day of arrival will be considered a fail to show up at the hotel/service provision point (“No-Show”), in which case final charges depend on the hoteliers/travel suppliers’ polices, when the hotelier has the right to charge the reservation in full, and is not obligated to inform about it at any stage. In certain cases (mostly but not restricted to, during fairs, congresses, sports and other special events, high occupancy periods etc.) some hotels/travel suppliers might impose longer cancellation deadlines, which will be provided to you with the booking confirmation, or subsequently as we are made aware of such by the Travel Suppliers, and the latter will be binding. If you are not in agreement with variances to the cancellation conditions as reflected, upon our notice to you, you will have the right to cancel your booking within 24 hours without incurring any charges. All and any cancellation or amendment requests must be made in wiring, by sending an email to the following address FIT@kenes.com We will not process any of your requests made by phone, and the original status of the bookings will be deemed accurate and applicable for all purposes, including charges and your payments obligations. If a hotel overbooks itself it will offer alternative accommodation for the clients. We will advise you as soon as practicable, following the receipt of such notice from the hotel/supplier, and you will be free to accept or decline and cancel the reservation with us within 24 hours. We will bear no further liability towards you and/or other co-travelling clients with respect thereof. Should you wish to re-book a different property at a higher price, you will be liable for the additional cost. VERY IMPORTANT: Any amendments or cancellations of bookings must be done via us and NOT the hotel/travel suppliers themselves. Should you fail to do so; full charges will apply for the services booked through us, and regardless of your dealings with the hotels/service providers directly. We will not accept any direct communication, correspondence or instructions from the third parties and in all instances of the same, sub-agents/clients will be immediately referred back to their booking agent. If you decide to shorten/partially cancel services while you are already using them (e.g. shorten your hotel stay and leave earlier than booked), it is highly advisable that you obtain a signed consent in writing from an authorized representative of the hotel/service provider that they will not be charging for the unused part of the services. This will facilitate our claim for refund on your behalf. In the absence of such document we will not be able to guarantee any refunds, and the full services cost as paid or payable to us will stand. All extensions and extra services outside the scope of the original vouchers provided by us, will be handled and paid by yourself directly on the spot, and we will not be held liable in any way for such dealings, which are fully at your sole discretion Notwithstanding the above, all and any refunds must be confirmed by the hotel/travel supplier first, and we will not be able to refund you if we do not receive refund from hotel/travel supplier for any reason whatsoever.

Payments

All bookings must be prepaid by credit card, at the time of booking, before payment is received in full, we are not obliged to issue any tickets, confirmations, vouchers, or other travel documents. However, you shall in all cases remain liable for payment of the amounts for the travel products and services ordered and booked. Only online credit card payments are accepted. If you want to pay by a credit card which belongs to a 3rd party (e.g. corporate clients), you must provide us with a signed credit card authorization form bearing the signature of the credit card’s holder, as well as advise the 3rd party client in writing and obtain their written and signed consent to use their card/s. Non-compliance with this condition will constitute a major breach of agreement. You will cover immediately in full all and any charge backs which might be filed against us by any 3rd party, for reservations paid with credit cards, by your company and staff online on our reservations system/s/, without right to dispute.

Termination & Suspension of Account and Services

These Terms and Conditions shall remain in effect until terminated as set forth herein. Your failure to comply herewith shall terminate your Account and any of the Services hereunder. In the event of your failure to comply herewith Operator may immediately block your access to the Website and/or temporarily or permanently limit, suspend or terminate your Account in addition to any other remedies that may be available to Operator under any applicable law. Such actions by us may be taken if we believe, in our sole discretion, that one (or more) of the following events have occurred: (a) there is a threat to the security or integrity of our network or our servers; (b) suspension is needed to protect the rights, property or safety of Operator, its Users or the public; (c) there is a basis for termination of your Account; (d) you have violated these Terms and Conditions; and/or (e) we are required to by law. During such suspension, you will not have the ability to use or access your Account. In the event that we will determine, in our sole discretion, that the reason for suspension of access to your Account has been resolved, we will restore access to your Account. If you object to any term hereof, as may be amended from time to time, or become dissatisfied with the Website, you may terminate these Terms and Conditions at any time by stopping your use of the Website and this will be you sole remedy in such circumstances. Operator may at any time, at its sole discretion, cease the operation of the Website or any part thereof, temporarily or permanently, extend in terms of content and form, correct, modify, amend, enhance, improve and make any other changes thereto or discontinue displaying or providing any information, content or features therein without giving any prior notice. You agree and acknowledge that Operator does not assume any responsibility with respect to, or in connection with the termination of the Website's operation and/or termination of your Account and/or loss of any data. The provisions of these Terms and Conditions that, by their nature and content, must survive the termination of these Terms and Conditions in order to achieve the fundamental purposes of these Terms and Conditions shall so survive. Without limiting the generality of the forgoing, the Intellectual Property, Disclaimer and Warranties, Limitation of Liability, Indemnification and General sections will survive the termination of the Terms.

We believe that you have a right to know our practices regarding the information we collect when you access the Website (including without limitation the Services available therein). You agree that we may use personal information that you provide or make available to us in accordance with the Privacy Policy. If you intend to connect to, access or use the Website you must first read and agree to the Privacy Policy.

User Restrictions

While using the Website and the Services, there are certain types of behaviors which are strictly prohibited, as appears in the list below. Please read this list carefully. Your failure to comply with the provisions set forth herein may result in the suspension or blocking of your use of the Website and the Services and may also expose you to civil and/or criminal liability. We act only as an intermediary in making arrangements for hotels, transportation or any other travel services and do not assume any responsibility or liability of any kind for the travel products and services provided by the final Travel Supplier and make no representations or warranties (express or implied) about the suitability or quality of travel products and services featured on this Website. Information, software, products and services presented on this website may include inaccuracies or typographical errors. We do not make any guarantee or representation as to the accuracy or proprietary nature of site content, and disclaim liability for inaccuracies relating to the information and description of all products displayed on this website. Hotel ratings displayed on this website (if any) are unofficial and intended as a guideline only. We, our affiliates and suppliers do not guarantee the accuracy of the ratings. All services and products presented on this Website are supplied by independent contractors/travel suppliers and are not agents or employees of the Operator. We provide on all our interfaces, XML interfaces inclusive, important remarks relating among others to the hotel property and/or services, e.g. renovations, minimum age at check-in, voucher presentation obligatory etc. It is your sole responsibility to communicate those remarks onwards to your clients and we will not accept any claims resulting from your failure to do so. We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from. We have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond our direct control, and we have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority. You agree to defend and indemnify us, our affiliates and/or our suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of your breach of these website Terms and Conditions and notices or the documents referenced herein, your violation of any law or the rights of a third party or your use of this website. WE STRONGLY RECOMMEND THAT YOU TAKE OUT INSURANCE FOR ANY TRAVEL ARRANGEMENTS YOU MAKE We reserve the right to change or update the Terms and Conditions relating to use of the website from time to time without prior notice to users. The current version of the Terms and Conditions will be displayed within this website from the date on which any changes come into effect. Continued use of this website, and/or any of the services provided hereunder following any changes to the Terms and Conditions shall constitute your acceptance of such changes.

General

Notwithstanding the foregoing Operator may seek injunctive relief in any court of competent jurisdiction, (d) if any provision of this Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this Terms and Conditions and will not affect the validity and enforceability of any remaining provisions, (e) no waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default, (f) any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof, (g) you acknowledge and agree that any cause of action that you may have arising out of or related to the Website and/or the Services must commence within one (1) year after the cause of action accrues. otherwise, such cause of action is permanently barred, (h) these Terms and Conditions constitutes the entire terms and conditions between you and the Company relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements or understandings between you and the Operator, (i) if any provision hereof is adjudged by any court of competent jurisdiction to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect while most nearly adhering to the intent expressed herein, (j) you may not assign or transfer these Terms and Conditions (including all rights and obligations hereunder) without our prior written consent and any attempt to do so in violation of the foregoing shall be void. We may assign or transfer these Terms and Conditions without restriction or notification (k) no amendment hereof will be binding unless in writing and signed by the Operator, (l) the parties agree that all correspondence relating to these Terms and Conditions shall be written in the English language. These Terms and Conditions are drafted in the English language. If these Terms and Conditions are translated into any other language, the English language text shall prevail. The terms “we”, “us”, “our/s” refer to the operator of this website, the terms “you”, “your”, “yours” refer to the users of this website.
